I wish the world would stop crapping on my family too. Unfortunately, I don't think it willl happen.

Tonight I want to watch Walk The Line or Pride and Prejudice...but they will be all gone by the time I can go get it. I hope I get invited to watch it...

My parents had to file for bankruptcy a few years ago, it was rough but they got through it and they're doing okay now. In they end they are better off having gone through it.

tonight i'm playing volleyball with my mom and a bunch of other random adults who play on tuesday nights. it's going to be way fun, except that i'm missing hardcore soccer conditioning. but it's okay since i conditioned for soccer 2 hours today already and i still have ballet later.
i'm a busy duck. wooooo.

Thing is, it's nothing that she/we've done wrong that's causing it. A freaking hospital that my dad stayed at 3 years ago while he was battling cancer decided to drop a $50,000 bill in my mom's lap today. A bill that should've been payed by his insurance years ago, but the hospital never submitted so now it's coming back at us. The bill also includes a lot of higher prices than were supposed to be charged for rooms and such. Meanwhile, the lawyer my mom talked to suggested filing for bankruptcy. Even though it's the insurance company and hospital's fault.

oh nikki *hugs* i wish i knew what to say, except this should be resolved between the insurance and the hospital, your mom shouldn't have to deal with it :neutral:

Talk to another lawyer. There HAS to be some way around that, because it's not your mom's fault and she should NOT have to file for bankruptcy. Seems to me that this is definite grounds to sue the hospital/take legal action against having to pay that.

I must agree with Robbo, definitley sounds like a good legal case to me. I mean if a robber can sue for being trapped in a garage by his own stupidity, you should be able to sue for a legitimate cause!

This is exactly what I've been telling my mom, but she's too irrational. She thinks with her emotions not her head. She also seems to think that filing for bankruptcy will be less expensive than hiring a good lawyer to sort all this out. *sigh*

I just hope the lawyer is a lot more helpful in real life when she's paying him for his time than he was on the phone.

There HAS to be a way to get through this without bankruptcy. Seriously, there HAS to be a way. Your mom has to seek legal advise from another source. Because this is absolutely fucking wrong, and there's no way your mother is responsible for this. Absolutely no reason that the onus should be put on her.

Oh Nikki this is awful *hugs* I'm having flashbacks as I read this....

We had a similar situation in my family and my uncle went through legal hell. Maybe it would have played out differently in another country or with a different insurer, I have no clue.

In our situation, the insurance company said it was past the appropriate time period for submitting claims (it was 2 years later), so they refused to pay it. The hospital said that the relationship is only between insurer and insured, and that they only submit claims as a service to patients. They are not ultimately responsible for ensuring they are received by the insurance company and paid, therefore if they made a mistake and didn't submit an invoice, it was not negligent in any way because it was not originally their responsibility. The hospital had made the original mistake but was cleared because it was deemed that their argument was correct. It was then a legal battle between my uncle and the insurer that lasted for another two years and finally ended in a settlement because it was bringing bad press to the insurance company.

hhmm... maybe this is not what you want to hear. Keep in mind this is just one example.

My grandmother died on Monday. I think I'm still in a state of shock. The worst part of it all is that I was there when it happened. Part of me is happy I got to see her one last time and be with her before it happened. But it was so unexpected and so graphic I'm traumatized from what I saw. I think I'd be mentally unstable by now if it wasn't for my years of tv desensitization. I also don't think it's fully set it yet that it really happened.

So, it's a really sad week for me. Almost like an end of an era. :no:
