I don't see how though. For non-pecuniary damages (things like broken bones/pain and suffering sort of thing) the maximum you can sue for is $100 000 give or take a little for inflation. The pecuniary damages would only cover her for loss of income and damage to the car and such. Unless the courts awarded punitary damages to punish the train company.... But that only applies if it's Canadian heh.

And, umm... I really doubt anyone would park their car on tracks and stay in it while a train hits it just for a scam. She's very lucky she's alive.
