BACK TO SCHOOL CONTEST (2005)
ROGERS CABLE COMMUNICATIONS INC.
1. Contest Period starts at 12:01 am Eastern on August 22, 2005 and continues until 11:59 pm Eastern on October 15, 2005, the Contest Closing Date. No purchase necessary. Only a maximum of two (2) entries per Rogers account and/or person will be accepted; and only 1 prize per person may be awarded.
(a) To enter, visit rogers.com/winOLPtickets to complete the entry ballot in full and submit it as instructed by the Contest Closing Date.
(b) Random draws by a representative of Rogers Cable Communications Inc. (�Rogers� or �Contest Sponsor�) from all entries received will be made at the times and in the manner set out in paragraph 2 below at Rogers� head office in Toronto.
(c)If a selected entrant cannot be reached within the time specified in paragraph 2 following the draw in which the ballot is drawn, incorrectly answers the skill-testing question, declines the prize, or fails to return a Declaration of Compliance and Release of Liability as specified below, another entrant will be selected in his or her place.
2. (a) There are a total of 1,055 pairs of tickets available to be won to attend an intimate concert event at Massey Hall in Toronto, Ontario on November 6, 2005 at which Our Lady Peace is scheduled to perform. Each of such pairs of tickets has an approximate retail value of $120.
(i) Region 1: Participants from Ontario (excluding the Ottawa area) are eligible to win one (1) pair of tickets out of a total of 1,000 pairs of tickets, with a total retail value of each prize being approximately $120. Draws for 200 prizes for entrants in Region 1 will be held at approximately 11:00 am Eastern on each of September 20, 27, October 4 and 11, 2005; a final draw will be held to award the balance of tickets available (a minimum of 200) or not claimed on or about October 25, 2005 at approximately 11:00 am Eastern. Entries selected at each of these draws will not be eligible in any of the draws occurring later in this Contest. Selected entrants drawn prior to October 25, 2005 will be contacted by email at the email address given on the entry ballot and given the opportunity to correctly answer the skill testing question. Successful entrants will be given a PIN number with which to claim their tickets. If they do not claim their prize by October 21, 2005 they will forfeit their prize and another ballot will be drawn. Selected entrants from the October 25, 2005 draw will also be contacted by email at the email address given on the entry ballot and given the opportunity to correctly answer the skill testing question. Successful entrants will be given a PIN number with which to claim their tickets. They must claim their prize by November 1, 2005 or they will forfeit their prize.
(ii) Region 2: Participants from the Ottawa region are eligible to win one (1) pair of tickets out of a total of 50 pairs of tickets, plus return transportation by bus from Ottawa plus one nights� accommodations at a local Toronto hotel (double occupancy), with a retail value of each prize being the value of the tickets ($120) plus the cost of the return bus trip and hotel accommodation of approximately $300. Draws for awarding prizes to residents in Region 2 will be held at approximately 11:00 pm Eastern on or about October 17. Selected winners will be contacted by phone at the telephone number on the entry ballot. If the selected entrant can not be reached within 2 days, another entrant will be drawn and the original will forfeit their prize.
(iii) Region 3: Participants from New Brunswick or Newfoundland & Labrador are eligible to win one (1) pair of tickets out of a total of � 5 pairs of tickets, plus return economy airfare for two to Toronto plus 1 nights� accommodations at a local Toronto hotel (double occupancy), with a retail value of each prize being the value of the tickets ($120) plus the cost of the return airfare and hotel accommodation of approximately $1250. Winners from New Brunswick will be responsible for their own travel to and from the Moncton airport. Winners from Newfoundland and Labrador will be flown from St. John�s to Moncton and if necessary given hotel accommodation for the night prior to the flight from Moncton to Toronto. Winners from Newfoundland and Labrador will be responsible for their own travel to and from the St. John�s airport. Additional retail value is approximately $500. Draws for awarding prizes to residents in Region 3 will be held at approximately 9:00 am Eastern on or about October 17, 2005. Selected winners will be contacted by phone at the telephone number on the entry ballot. If the selected entrant cannot be reached within 2 days, another entrant will be drawn and the original will forfeit their prize.
Choice of accommodations and transportation are at the discretion of the Contest Sponsor. All other expenses not specifically mentioned in these Rules (including ground transportation not mentioned, meals, beverages, gratuities, travel documents, taxes, personal and all other expenses incurred) will be the sole responsibility of each winner. No responsibility is assumed by Contest Sponsor for the event�s cancellation, delay, suspension or re-scheduling for any reason, or for any travel interruption for any reason whatsoever beyond its control; and Contest Sponsor shall not be required to make any financial restitution therefore. Other restrictions may apply. Travel must be taken on the dates and times specified by the Sponsor or its agent, or will be forfeited. Winners and traveling companions must have all necessary identification and documents to permit travel. If, for any reason, any of the scheduled events comprising the Grand Prize do not occur, ticket portion of prize will be forfeited without additional compensation.
(b) Prizes must be accepted as awarded and may not be transferred or exchanged, or taken at any other time. Failure to attend on the date of the concert results in forfeiture of the prize. Contest Sponsor reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prizes.
3. To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question given at a mutually convenient time; and will also be required to sign and return a Declaration of Compliance and Release of Liability & Publicity within a specified period of time, for both the selected entrant and his/her travel companion, failing which the prize will be forfeited. Contest judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
4. This contest is open only to residents of Ontario, New Brunswick and Newfoundland and Labrador who are over the age of majority in their province of residence, excluding employees of Rogers, its/their parent and affiliated companies, representatives, dealers and agents, contest suppliers and judges, and those with whom they are domiciled. The contest is subject to all applicable federal, provincial and municipal laws and regulations.
5. By entering this contest, entrants consent to the use of their entry, name, city of residence and/or any photograph of or that may be taken in publicity carried out by the contest sponsor(s) and/or their advertising agencies, without further notice or compensation.
6. No communications will be entered into except with selected entrants. Odds of winning depend on the number of eligible entries in each of the three (3) Regions described above, and the number of prizes allocated to each region. There are a total of 1000 prizes allocated for residents of Ontario (except Ottawa area residents); 50 prizes for Ottawa area residents; 5 prizes for residents of NB or NL. The prizes have the descriptions and values set out in these rules. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by the contest sponsor(s). Contest sponsor(s) takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Contest sponsor(s) is/are not responsible for any errors or omissions in printing or advertising this contest. All entries become the property of the contest sponsor(s) and will not be returned.
7. (a) By entering this Contest, entrants release and hold harmless the contest sponsor(s), its/their advertising and promotional agencies and the contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the �Releasees�) from any liability in connection with this Contest or, if declared a winner, the prize(s).
(b) Winners� guests, all of whom must also be over the age of majority, must also sign and return a Declaration and a Liability/Publicity Release prior to being ticketed or within such other period as Rogers may specify. Winners guests cannot be changed after the Declaration and Release are received, By accepting a prize, winners and their guests consent to the use of their name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any media or format without further compensation or notice.
8. Contest sponsor(s) is/are collecting personal data about entrants for the purpose of administering this Contest.
9. This contest will be run in accordance with these rules, subject to amendment by Contest Sponsor. Contestants must comply with these rules, and will be deemed to have received and understood the rules by participating in the contest. The terms of this contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
10. (a) Contest sponsor(s) assume(s) no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant�s or any other person�s computer related to or resulting from playing or downloading any material in the promotion. Contest sponsor(s) reserve the right, in its/their sole discretion, to cancel or suspend the email portion of this contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the contest.
