There's an age you can legally consent to sex. As it stands 14 (possibly 16, they were trying for 16) you can consent to have sex with people 14 and over.

You can't be charged under the law if you're both under 14. If a 13 year old had sex with a 14 or 15 year old though the older kid is charged.

so there is not a minimum age to have sex. there's a minimum age to have sex with someone older.

Well it's the legal age to consent to sex. The criminal code just prohibits charging people under the age of 14. http://laws.justice.gc.ca/en/C-46/267262.html

That's not right.
There's always a two-year window.
If a thirteen year-old had sex with a 16 year old, that would be a problem. For the 16 year old.
but 14 and 15 are fine.

Unless the law passed for the 16 year thing where it was proposed for a 5 five year window going up but not down.

i'm pretty sure how it goes is that if you had sex with someone older, and you're under the legal consent age, it legally means they raped you, because you weren't old enough to "know better".
