it is not to say if you don't have sex then the marriage isn't legal - it still is. you do not NEED to have sex for a marriage to be legal, but it's a safety valve of sorts (outdated and redundant i believe, but it hasn't been removed from law as of yet)
i actually know of a couple that got an anullment based on this...they were young (18 and 20) and when he was too nervous to get it up, they realized that they werent ready for marriage *note, this is an oversimplified version of what happened. there was much agony, soul-searching, arguement, etc. invovled* and went to the courts, declared they had not consummated their marriage, and so the courts recognized that their marriage never in fact existed.
